Acting on behalf of the wife in divorce proceedings, based on the fact of her husband deserting her. The parties married, after meeting through a dating website, and following a whirlwind romance.
The marriage took place in Zimbabwe at the request of the husband, and it was consummated. The wife found out that during their stay in Zimbabwe following the wedding, that the husband had committed adultery with an unknown woman.
The wife flew back to the UK. After a few months the wife attempted to make contact with the husband, predominantly through social media as she was not sure of his whereabouts. A few messages passed between them, but the husband would not reveal where he was living.
Two years later the wife decided she needed closure, and wanted to proceed with a divorce. Difficulties arose as she had no idea where her husband was. Attempts were made to track down her husband but to no avail. An application was made to the court to dispense with service of the divorce petition on the husband. The application was granted and the divorce proceeded without the husband’s involvement.
